To qualify for state nomination, you must meet all nomination requirements relevant to your situation and occupation.
You must ultimately meet all the Department of Home Affairs' criteria and requirements.
Before applying for State Nomination, you should work out if you have sufficient points on the Department of Home Affairs' points test to apply for the 190 permanent or the 491 provisional visa. It is important to check the requirements below and the occupation lists to see if you are restricted to applying for a 491 state nominated visa.
Please read through the nomination requirements below and the document checklist before applying.
1.1 State nomination is provided to meet skills needs of this state and is granted on the basis of the applicant’s genuine interest and commitment to living and working in South Australia with a view to long-term settlement.
- Your commitment to South Australia commences from the date of arrival for settlement
- For those already living in South Australia, your commitment to South Australia commences from state-nominated visa grant date.
You must confirm this commitment by:
1.1.1 Undertaking first-hand, thorough and meaningful research on South Australia including: lifestyle, education and employment opportunities, and providing your reasons for wanting to migrate to South Australia in the online application form.
1.1.2 Undertaking research on job opportunities in South Australia and any occupation training, licensing or registration requirements.
1.1.3 If you are onshore, you may be required to provide evidence of South Australian residence and that your employment has primarily been in South Australia.
1.2 When you arrive in South Australia on a state nominated General Skilled Migration (GSM) visa, you are required to:
1.2.1 Register your arrival in South Australia on Immigration SA's Apply website (this needs to be completed when you arrive to settle in Australia)
1.2.2 Maintain up to date contact details through Immigration SA's Apply website
1.2.3 Complete regular online employment surveys as requested and shown on Immigration SA's Apply website.
1.3 The following commitment to state restrictions apply.
1.3.1 If you are in Australia but not currently residing in South Australia, you are ineligible to apply for state nomination.
1.3.2 If you are currently offshore and have previously studied or worked in another Australian state or territory (i.e. on a temporary visa) and not in South Australia in the last 10 years, you are only eligible to apply for a provisional 491 visa. Please also note 1.3.6.
1.3.3 If you have studied or worked in another Australian state or territory as well as in South Australia in the last 10 years, you will generally only be eligible to apply for a 491 provisional visa (and not a 190 permanent visa) unless it is clear that your commitment is more clearly aligned to South Australia than to any other Australian state or territory.
Factors that will be taken into account will include the time spent in South Australia, the most recent Australian location you spent time in, and what you were doing in these locations (i.e. study, work).
Note: If 1.3.3 applies to you, select the “491” visa on your state nomination application. If you wish to be considered for a 190 nomination, still select the “491” visa in your application and attach a separate supporting statement outlining your 190 visa request and demonstrated commitment to South Australia. On your Expression of Interest (EOI), you should select both “491” and “190”.
1.3.4 If you are currently residing in South Australia, and have lived, studied or worked in another Australian state or territory before moving to South Australia, you must be currently working for the last 6 months (minimum 20 hours per week) in a skilled occupation in South Australia and meet all other state nomination requirements.
1.3.5 If your nominated occupation is listed as 'Provisional 491 visa only' - 190 nomination offered to applicants under specific circumstances only, you must meet the requirements outlined in section 3.5 below to be considered for a 190 nomination. If your occupation is listed as 'Provisional 491 visa only', you are only able to apply for a 491 nomination - see 3.4 below.
1.3.6 Immigration SA reserves the right to either offer a 491 provisional visa (for applicants otherwise eligible for a 190 visa nomination) or to refuse your application if your commitment to South Australia is not sufficiently demonstrated.
1.3.7 Immigration SA will only provide one nomination per applicant.
1.3.8 Provisional 489 or 491 visa holders are not eligible to apply for South Australian state nomination.
